What can be the Child’s Religion when parents belong to different religion?
I am hindu and my wife is a muslim and we both got married under Special Marriage Act 1954. Can our kids have any one of our religions. I need a legal advice on this. Does law permits to have any religion of the parents or just the religion of the father.

Why not let your child have the religion they choose to have. Teach them about both religions and let them decide for themselves which to be.

There is no law stating that a child has to be raised in any particular religion. just raise them in the religion of whichever one of you practices their faith more. That way it’s easier.

When the child is old enough to choose for themselves allow them to make their own decision so they are not unhappy about what religion they are.

At some point, your children will pick their OWN religion. I would practice your given faith, and explain what you believe, WHY you believe and show tolerance toward the other faith. Let each parent show what they believe and why. At some age, your kids will choose their own path . . .

Dear friend there is noting called religion in marriage as it is a bond between 2 people and if you are so particular about religion discuss with your wife and then come to a conclusion, if you think anyone should change religion then the child can take up that religion.Please refer to a lawyer for further clarification.

Basically kids (minors) belong to the religion of their father.The bringing up the children will decide to which religion they belonged to.After attaining majority the child then as a major can opt for the religion he wanted to profess & practice.However, during their minority it is the father religion that is labeled.
After the marriage the religion of both the spouses continued to be intact.freedom of religion has been guaranteed under the constitution of India.As the child can not determine its religion on its own the natural guardian(father) is having that right of determination of religion of his minor children.Mother is not the natural guardian in the presence of father, as the law says so .
